The RAAP decision of the European Court of Justice does not take all relevant legal aspects of the field in consideration, and the arguments advanced by the Court regarding human rights are formalistic and not convincing. The decision is causing a major upheaval in the field of protection of performers, but its repercussions also seem to go much further creating uncertainties, for example regarding the protection of works of applied arts.
