Because the debate, in the courts as well as in the academic world, remains heated as to the difference to be made between originality and novelty in the assessment of the protection of a work by copyright, it is interesting to go back over the origin of this confusion and its evolution, through a chronological study presenting the conflicts and the links existing between the conditions of protection of copyright and design law
