The exception of text and data mining, modified by directive 790/2019, was thought in a weak technological framework. Artificial intelligence tools and their need to use unbiased data sets during the training phase suggest that this exception, in its new configuration, could deprive database producers of a legitimate recipe, justifying their property rights.
