Regulation of literary and artistic property: the powers of the audiovisual and digital communication regulatory authority (Arcom) to protect creation

Résumé :

Since 1 January 2022, pursuant to Act no. 2021-1382 of 25 October 2021 on the regulation and protection of access to cultural works in the digital age, the Autorité de régulation de la communication audiovisuelle et numérique (Arcom), the result of the merger of the Conseil supérieur de l'audiovisuel and the Haute autorité pour la diffusion des œuvres et la protection des droits sur l'internet, has been entrusted with new missions in the fight against cultural and sports piracy.
With the creation of this new regulatory authority, the strategy for combating piracy has evolved, with Arcom operating and embodying the transition from the historical mechanisms aimed at Internet users to those designed to target illegal services. The Authority has thus been given greater powers to strengthen the traditional mechanisms for protecting against copyright infringement on the Internet, in collaboration with copyright holders and other players and institutions likely to be involved in the fight against piracy.
